Four
Meridian digital surround processors with serious failures and
malfunctions.
Two Meridian 861 processors
with serious malfunctions recognized by Meridian still remain
at home of this Spanish costumer called Jose Alvarez.
More than 10 years from
first purchase -Meridian 565 7.1 + Meridian 562V- and the problem
has not yet solution.
From the beginning
Meridian 565 7.1 made an ugly noise under digital domain and
didn't work properly with some DVD players (Sony, Pioneer) but
neither Meridian dealer Clave
Audio nor Spanish Meridian distributor Chemison
accept their responsibilities.
Wishing to buy a Meridian
586 DVD player, when customer asked Meridian, this company said
that 586 DVD was only available for USA (Zone 1), not for Europe
(Z 2).
Two years after purchase,
Meridian offered an update called 6.0 for 565 7.1 problems.
Customer sent a fax to Chemison,
Clave Audio and
Meridian saying
all this companies that he was agree with this update but neither
Meridian dealer Clave Audio
nor Spanish Meridian distributor
Chemison wanted to apply it.
Two lawsuits
and one appeal against Spanish Meridian distributor Chemison.
Because
fatal failures in Meridian 565 7.1 and due to Meridian claimed
that Meridian 561 processor features and perfomances were similar
to Meridian 565 7.1, this customer bought a Meridian 561 processor
to show the judge what features and perfomances Meridian 565
7.1 lacked but Meridian 561 would show to have. But Meridian
561 didn't play subwoofer channel under MPEG format.
Meridian 565 7.1 and
561 processors were tested by Acoustic Institute of Madrid.

this Official Institution confirmed all failures listed here.
Due to neither
Chemison nor Clave Audio did nothing to solve customer problem,
3 years after first purchase, when this customer made first
lawsuit against Chemison, Meridian managers told to this customer
they want to find a solution to this problem.
Meridian changed 565
7.1 (+ 562V) and 561 processors by a Meridian 861 (s/n 100803)
paying customer the difference between them.
Meridian Marketing
Manager Mr. Andrew Samalionis set and installed a customized
861 processor at customer home past 10/07/2000. But this
861 processor made an ugly noise when DVD tray went open.
Meridian
recognized the fault was in the processor -probably with substandard
quality parts- and
sent to customer a second customized Meridian 861 unit (s/n
100843) past November 2000. But this
new 861 unit turned off/on by itself and blocked its buttons
so the processor didn't work in any way.
Meridian
again recognized the fault was in the machine and again offered
to customer a new third Meridian 861 to solve this problem.

When customer was thinking
about this Meridian proposal, Chemison
& Clave Audio made three attempts to put this customer in
jail through a criminal suit because "my complaints lowered
their prestige". Amazing! 4 Meridian processors with fatal
failures didn't lower their prestige.
At Christmas 2000,
this customer told to Meridian managers the barbarism commited
by Chemison and Clave Audio saying them that this criminal suit
wasn't any solution to problem. Meridian
managers didn't listen to me and they didn't do anything else
to solve this problem..
Due to this criminal
suit, new lab reports
of two Meridian 861 were necessary in order to defend customer
showing to Judge all fatal failures of these machines which
were confirmed by Acoustic Institute. You can look Meridians

But the
Judge told three times to Chemison and Clave Audio that he didn't
find any reason to put customer in jail. And Chemison &
Clave Audio criminal suit and appeals was stopped for ever.
About my sue against shameless Chemison,
other Judge said that Chemison didn't sell anything to this customer
so Chemison wasn't responsible of this infamy. Naturally, customer
lawyers have appealed this case and this blunder.
Past 12/31/2004, seven
years after customer's first purchase and due to
this web site appeared on the Internet, Clave
Audio managers recognized: "it's
true customer had problems with Meridian gears, it's true that
customer showed to Chemison that his Meridian 565 7.1 didn't
work properly at Clave Audio shop. It's true that Clave Audio
managers were witness of this event and it's true that customer
was agree with a Meridian update called 6.0 offered by Chemison
and Meridian". But
neither Chemison nor Clave Audio applied this update to Meridian
565 7.1: Clave Audio was waiting that Chemison
did this update (Eprom changing included) and Chemison was just
waiting that Clave Audio did it too. Both are waiting
customer get tired to fight this case.
Meridian
still continues to do business with shameless and brave-face
Chemison & Clave Audio companies. They didn't solve customer
problem but they attempt to put customer in jail to escape complaints
customer and their responsibility in this case.
Actually, customer
has 2 Meridian 861 digital surround processors with fatal failures.
But neither Chemison nor Clave Audio do anything to solve this
problem and compensate damages to customer.
Why don't Chemison
and Clave Audio do nothing to solve customer problem? Because
they say and think that Meridian must solve the problem. And
because they're afraid of damages caused to customer with its
wrong criminal sue..
Why doesn't Meridian
do nothing to solve customer problem? Because its shameless
distributor and dealer, Chemison and Clave Audio, respectively,
wanted to put customer in jail, wanted to hit me and sent to
hospital past 01/05/04 and want to eliminate me. Meridian doesn't
want to be responsible of all these barbarisms. In sum, customer
is being damaged over seven years along and there isn't any
company with an appropriate response to this villainy. All these
companies cover their disgraces with silence as single response.
Customer has sent letters,
e-mails, etc to these three companies but nobody answer them.
Customer let these companies
know years and months in advance that he was doing this web.
Companies response have been the silenceso
they don't matter this web continue on air for ever and they
deserve this web a lot.
There isn't any sue
against this web site because Chemison,
Clave Audio and Meridian know the story of this web is true
and they only can have more problems if do a new sue against
customer. Actually, every company knows a new sue against customer
can cause damage to others and all possible sues against me
are over while they don't solve this file.
I advise
to all home cinema, audiophiles and hi-fi customers, to all
consumers visitors of this web: please, remember this file at
time to buy A/V components, remember this brand Meridian and
these companies Chemison and Clave Audio. I beg to all visitors
send this file and web page to their family, friends and other
contacts in order to avoid that none customer around the world
can be seriously damaged by these miserable companies. Thank

Dear Sir,
I write in regard to the conflict with Chemison, your distributor in Spain, on the matter of the Meridian processors, which you do not believe to be your responsibility. I would like to inform you of the following:
The criminal suit that Chemison and Clave Audio pursued against me for years, demanding a solution for their Meridian processors with serious operating malfunctions, has been definitively dismissed by the court and shelved without trial.
The three attempts by Chemison and Clave Audio to put me in jail, in order to be able to shirk their responsibilities, have been failures. They no longer have grounds for appeals, lawsuits or actions against me.
When these pending legal proceedings ended, I filed a new lawsuit (the second) against Chemison regarding the Meridian processors. This time Chemison was unable to avoid the lawsuit: the trial is set to begin on 1 October 2003 in Madrid.
Like Meridian, Chemison believes that this matter is not its responsibility, but rather the exclusive responsibility of Meridian as the manufacturer of the defective processors. And you can be sure that Chemison will let the Judge know this. To better cover any contingency, Chemison has been the distributor of Lexicon in Spain since March 2003.
Brilliant! From November 1997 to date:
There has been one Meridian processor with a certified minor malfunction on one DSP channel.
There have been three Meridian processors with very serious operating malfunctions, certified by the Instituto de Acústica (Acoustics Institute) and recognised in writing by Meridian for the two 861 models.
Chemison has
made three attempts to put me in jail.Meridian
still continues to do business with Chemison.
Is Meridian not ashamed of
Chemison's disgraceful behaviour? Or, since
no one can deny that I am right, does Meridian agree with such
behaviour?
I have filed two lawsuits against Chemison. (Could a lawsuit against Meridian also be necessary?)
Chemison believes that it does not have to solve this problem. Meridian believes that it is an issue to be handled by the distributor, who has been trying to put me in jail. Who, then, should take care of this matter? The late Mother Theresa, perhaps?
You must think that Spain is some
kind of banana republic, as you have tried to mock me with impunity
for so many years. But I am certain that our Spanish judges will
take note of Chemison's and Meridian's absolute disdain for the
law, for justice and for accountability to people, consumers and
citizens.
I was negotiating this conflict
with Meridian when Chemison launched its criminal suit against me
to abort the negotiations. The Judge, my lawyers and I would all
like to know whether Meridian's position continues to be that of
protective silence and consent for Chemison's actions, or whether
it has changed. Is there really any difference between Chemison
and Meridian? If so, please let us know your position. And if not,
I remind you that the strategy of silence as a response has not
enabled Chemison to free itself of two lawsuits.
If Meridian still wishes to remain
uninvolved, in order to defend Chemison or for any other reason,
then I will take that to mean that you understand and accept and
do not care about the inevitable bad publicity and damage to the
Meridian brand that will be caused by future action of all kinds,
required by the magnitude, singularity and severity of the case.
I say of all kinds because clearly, up to now, legal action alone
has not been enough to solve the problem.
Perhaps Meridian should reflect on the fact that the failure to solve the problem by judicial means or through negotiation will do you more harm than good. You should realise that you cannot avoid having to choose between Chemison and Meridian. Chemison has already chosen Lexicon. Now it is up to you to choose.
